AURA ADORNS — TERMS & CONDITIONS OF USE

At Aura Adorns, we are committed to provide you the best service possible while we respect your privacy and safeguard your personal information. This Terms & Conditions of Use (“Terms”) govern your access to and use of our website (www.auraadorns.com.au), and mobile site, and any related services (collectively, the “Site”), including browsing, purchasing our products, and interacting with our contents. By accessing or using the Site and placing the order, you agree to be bound by these Terms and our Privacy Policy and other related polices placed in the Site footer. If you do not agree, you must refrain from using the Site.

1. Definitions

Products - means jewellery, accessories, gifts, gift/greeting cards, and related items sold by Aura Adorns. 

You/your means any user of the Site, including customers.

Order means a request you submit to purchase Products.

Custom / Made-to-order means any Product made or altered specifically for you (including engraving, bespoke sizing, special stone/metal choices and additional purchase).

2. Eligibility & Use of The Site

You must be at least 18 years old to place an Order. You agree to use the Site lawfully and not to:

  • misuse the Site (e.g., hacking, scraping, introducing malware),
  • interfere with security or functionality,
  • impersonate any person or misrepresent your affiliation,
  • post unlawful, harmful, or infringing content.

We may suspend or terminate access to the Site if we reasonably believe you have breached these Terms.

3. Accounts

If you create an account at the Site:

  • you are responsible for maintaining confidentiality of your login details,
  • you agree to provide accurate and current information,
  • you must notify us promptly of unauthorised access.

We may disable accounts that we suspect are compromised or being used unlawfully and against the Site policies. 

4. Product Information & Availability

We strive to display Products accurately, but you acknowledge:

  • product size and colours may vary due to the qualify of the picture taken and customer screen settings. 
  • handmade items and self assembled items may have variations in size,  finish/texture than what appeared on the Site. 
  • Artificial jewellery and natural gemstones may differ in colour, clarity, and pattern.
  • Models used to display products on the Site are software‑generated and AI‑generated for illustrative purposes only. Actual product size, colour, and appearance may vary from the images shown

All Products and products offers/promotions are subject to availability. We may limit quantities and discontinue Products and offers/promotions at any time without prior or post notification. 

5. Pricing, Currency & Taxes

Prices are shown in Australian Dollars (AUD/A$) and product price may change without notice. Where applicable, prices may includes/excludes taxes such as GST will be calculated at the checkout, with or without.  For Other charges such us Shipping, duties, and import fees, please visit the Shipping Policy.

If a pricing error occurs, we may cancel or adjust the Order (and refund any amounts paid) even after an Order is submitted by the customer. 

6. Orders & Contract Formation

When you place an Order, you make an offer to purchase. An Order is not accepted until we:

  • send you an Order confirmation (and/or)
  • dispatch the Products.

We may refuse or cancel Orders for reasons including:

  • stock unavailability,
  • Promotional price no longer available and right to take back the promotional price.
  • suspected fraud,
  • incorrect pricing or listing information,
  • inability to deliver to the provided address.
Amounts will be refunded to customers in such cases, except where the customer’s actions are unlawful and/or involve attempts to steal, misuse, or unlawfully access the Site’s data, or otherwise cause harm to the business operations.

7. Payments

We accept a variety of payment methods, including debit and credit cards, Afterpay, PayPal, and any other payment options displayed at checkout. Aura Adorns is not liable for any loss of funds incurred while browsing the Site, placing an order, or receiving a refund, as all payment information is stored and processed by card issuers and third‑party payment gateway providers, not by Aura Adorns.

8. Shipping, Delivery & Risk

Shipping options, costs, and estimated delivery windows are shown at checkout. Delivery estimates are not guarantees and may be affected by:

  • carrier delays,
  • customs processing (if international),
  • weather or events outside our control.

You are responsible for providing a complete and correct delivery address. If an item is returned due to incorrect address details, you may be charged for re-shipping.

Unless otherwise required by law:

  • Risk of loss passes to you upon delivery to your nominated address.
  • In addition to above, all the orders are shipped without the signature on delivery. If it is required, you need to contact us before placing order as we are not liable once the orders are shipped or/and delivered. Proof of packaging and shipment will be provided if its is requested by the customer.

9.Click & Collect / Local Pickup (If Offered)

If local pickup is offered:

  • pickup details and timeframes will be provided after purchase,
  • you may be required to show ID and Order confirmation to collect the order. without the required information or documents we may not be able to pass the order. If another person is collecting the order of your behalf then the customer needs to contact us and notify about it and share the person name and acceptable ID proof. 
  • uncollected Orders after 5 days may be cancelled and refunded (minus processing and packaging fee which is 25% of the product price).

10. Custom, Made-to-Order & Personalised Items

Custom/made-to-order/personalised Products/self assembled are created specifically for you and typically cannot be cancelled, returned, or exchanged for change of mind once production begins.

You are responsible for confirming:

  • spelling for greeting cards and engraving,
  • sizing details if any (e.g., ring size, chain length),
  • selected materials/stones, if any

We will not be responsible for errors in custom details supplied by you.

11.Jewellery Care, Allergies & Wear

You acknowledge that jewellery can be delicate and may require care. Unless otherwise stated, our items may be affected by:

  • exposure to water, perfumes, lotions, sweat, chlorine, and cleaning chemicals,
  • impact, pressure, or improper storage,
  • normal wear and tear (including plating fading over time).

If you have any metal sensitivities or allergies, please review the product materials carefully and contact us prior to making a purchase. We do not guarantee that all items are hypoallergenic, and we cannot ensure that they will not cause a reaction. Aura Adorns is not liable for any skin irritation, allergic reactions, or damage to jewellery under any circumstances. Therefore, it is your responsibility to verify and ensure that the product you choose is suitable for your personal needs and suitable to wear. 

12.Discount codes and promotions

Promotions:

  • apply only during the stated period,
  • may exclude certain Products (e.g., sale, bundles, custom),
  • cannot usually be combined unless stated.

We may modify or withdraw promotions at any time

13.Intellectual Property

All content on the Site—including product images, logos, designs, text, graphics, and branding—is owned by or licensed to Aura Adorns and protected by intellectual property laws.

You must not copy, reproduce, distribute, or create derivative works based on any content from this Site without our prior written consent. Additionally, products sold on the Site are for personal use only and are not permitted for resale, nor may they be sold or distributed by any party other than Aura Adorns.

14.Reviews, Comments & User Content

If you post reviews or submit content:

  • you represent it is accurate, lawful, and does not infringe third-party rights,
  • you grant Aura Adorns a worldwide, royalty-free licence to use, reproduce, and display that content for marketing and operational purposes,
  • we may remove content at our discretion (e.g., abusive, misleading, or unlawful content).

15.Third-Party Links & Services

The Site may contain links to third-party websites or services (e.g., payment providers, social media). We are not responsible for third-party content, terms, or privacy practices and you use at your own risk.

16.Limitation of Liability

To the maximum extent permitted by law:

  • We exclude liability for indirect, incidental, special, or consequential losses (e.g., lost profits, loss of opportunity).
  • Our total liability for any claim relating to the Products or Site is limited to the amount you paid for the relevant Product(s), except where laws require otherwise.

Nothing in these Terms excludes consumer guarantees or rights that cannot be excluded under applicable law.

17.Indemnity

You agree to indemnify Aura Adorns from any claims, losses, damages, liabilities, and expenses arising from:

  • your breach of these Terms,
  • your misuse of the Site,
  • your violation of any law or third-party rights.

18.Changes to These Terms

We may update these Terms periodically. The updated version will be posted on the Site. Your continued use of the Site after changes become effective constitutes acceptance of the updated Terms for time you use and place the order.
